Article 1 - NRTO
The LOI is a member of the Dutch Council for Training and Education (NRTO). These General Terms and Conditions are in line with the Consumer General Terms and Conditions and the code of conduct of the NRTO.
Article 2 - Offer
- The LOI's offer contains a complete and accurate description of the Training and/or the Training Material that is part of the Training.
- The offer clearly and comprehensibly states the following information:
- when the Training starts;
- the admission requirements to participate in the Training;
- the Price including all additional costs and taxes;
- the payment method;
- the Study and Service duration.
- These General Terms and Conditions are explicitly communicated to the Customer prior to the conclusion of the Agreement between the Customer and the LOI, and are an integral part of the LOI's general information provision. The General Terms and Conditions are fully applicable to all agreements concluded between the LOI and the Customer.
- Without prejudice to the provisions of paragraphs 1 to 3, in the case of a Distance Agreement, the offer also includes the following information:
- the identity and address of the LOI, including the visiting address;
- the Customer's right to terminate the Study Agreement within 14 calendar days in accordance with Article 8.
Article 3 - Conclusion of Study Agreement
- By enrolling in a Training, the Customer enters into a Study Agreement with the LOI for the agreed Service duration and agrees to the General Terms and Conditions as stated here.
- Enrollment for a Training takes place (i) via a physical registration form, (ii) by telephone, or (iii) via the web form on the Website.
- The Study Agreement is concluded as soon as the LOI has received acceptance of the offer from the Customer and has confirmed receipt thereof. Confirmation takes place immediately after registration by email.
- In the case of HBO programs, the Study Agreement, together with these General Terms and Conditions, constitutes the first part of the Education Agreement (OOK). The second part of the education agreement (regarding the study schedule) is concluded with the coach at the beginning and during the study.
- Fulfilling any admission requirements for a Training is not a condition for the conclusion of the Study Agreement. Even if the admission requirements are not met, the Study Agreement is concluded.
- The Customer is not entitled to transfer the rights and obligations from the Study Agreement to a third party without the written permission of the LOI. The Customer is also not entitled to allow a person other than the one mentioned on the registration form to participate in an Open Line Training without the written permission of the LOI. The LOI may attach further conditions to this permission.
Article 4 - Additional Information
- When enrolling in a legally recognized (MBO, HBO) Training, the Customer is obliged to provide a number of legally required additional data. Within 30 days, the Customer must provide the following data:
- Copy of the diploma(s) approved by the LOI;
- Personal identification number (PGN), which can be a BSN number or education number; and
- A (signed) education agreement. After receiving the data mentioned under point a) and b), the education agreement will be sent to the Customer. In the case of an MBO Training, the agreement must be signed and in the possession of the LOI within 30 days after the registration date.
- If the data referred to in paragraph 1 above is not provided in a timely and/or complete manner or does not meet the requirements applicable to the respective Training, the Student may not (further) study at any time and may not participate in exams.
Article 5 - Price
- The costs of the Training, the payment method, the number of payment terms, registration fee, examination fee, and any other additional costs are stated in the Training information.
- For companies and institutions, LOI Zakelijk B.V. can make a specific training proposal for an In-company/customized training. This offer replaces the price information as stated in the Training information on the website and/or study guide.
- All amounts mentioned by the LOI are exclusive of VAT. A legally recognized Training is exempt from VAT and will be provided by Leidse Onderwijsinstellingen B.V.
- A non-legally recognized Training is generally subject to the applicable VAT rate and will be provided by LOI Zakelijk B.V.
Article 6 - Payment
- The LOI is entitled to obtain information about the creditworthiness of a Customer who has registered for the Training from third parties. This may affect the offered payment terms.
- Payment of the Price must be made no later than the due date as stated on the respective invoice. The LOI has a payment term of 14 days.
- The Customer is automatically in default without the need for an additional notice of default from the date on which the applicable payment term has expired and the due invoice amount has not been paid in full. The LOI will then send the Customer a payment reminder, after which the Customer can still pay within the period stated therein. If the Customer has not paid the due invoice amount even after this period, the LOI may charge the Customer statutory (commercial) interest from the date on which the original payment term has expired.
- Any extrajudicial or judicial collection costs will be borne by the Customer. With regard to the amount of the extrajudicial (collection) costs, the applicable statutory regulations will be followed.
- Private Customers remain responsible at all times for obligations arising from the agreement with the LOI. This applies even if the payment is or will be transferred to a third party, such as an employer.
Article 7 - Right of Withdrawal
- If the Customer is a private individual, the agreement may be canceled free of charge and without giving reasons within 14 calendar days after it has been concluded.
- The Customer exercises the right of withdrawal by completing the withdrawal form within this period and sending it to the LOI. The form is available at www.loi.nl/herroepingsrecht.
- After receiving the request for withdrawal from the LOI, the Customer has an additional 14 days to return any received items, including Training material, sufficiently prepaid. The LOI will refund any paid tuition fees as soon as possible.
- Returns will only be accepted if the items are in their original condition. This means undamaged and unmarked, complete, only treated as necessary for inspection, and in the original packaging. If these conditions are not met, the LOI will not accept the return and the Customer will be obliged to reimburse a depreciation determined by the LOI.
Article 8 - Studying from abroad
Customers abroad pay a surcharge per month to cover additional costs, including shipping. Contact days, meetings, and exams are only organized in the Netherlands.
